Terms of Use

The terms below govern requests submitted through cmmcalibrationlouisville.com, the quotations issued in response, and the performance of CMM Calibration and related work arranged through this site. Either a request submitted or a quotation accepted is acceptance of them. Where a signed supply agreement or agreed purchase-order terms are already in place, those take precedence over these terms to the extent of any conflict.

Every request is reviewed before a quotation is issued. That review confirms that the requirement is stated clearly and understood, that the method, range and measurement capability needed are available, and that the laboratory selected to carry out the work is competent to perform it.

Where a statement of conformity is required, the decision rule to be applied is agreed in writing before work begins, together with the specification the item is to be assessed against. If a requirement changes after acceptance, the review is repeated and the change is confirmed to the customer before work continues. Requests that cannot be met as specified are declined, or returned with an alternative scope — never accepted and quietly reduced.

Quotations are issued in writing, and each holds for thirty (30) days from the date of issue unless the quotation itself states a different period. What it is built from is the item description, quantity, measurement points, tolerances and turnaround supplied with the request.

Any item that arrives differing from the item described changes the position — additional channels, a wider range, damage, or a condition needing repair before measurement is possible. Work is held while a revised quotation is issued, and nothing proceeds until that revision is approved in writing.

Quoted turnaround is in business days, counted from receipt of the item or from receipt of written approval to proceed — whichever of the two is later. Expedited handling is offered where capacity allows and quoted separately. Commitments rest on current capacity and are given in good faith. Where one cannot be met, the delay is notified as soon as it is known and a revised date is given with it.

Items must be shipped in protective packaging adequate for transit, together with any accessories, fixtures, cables or software needed to complete the work. Transit risk in both directions rests with the customer unless carriage has been arranged and charged on the quotation.

Items found to be unsafe, contaminated, or outside the condition accepted at review are returned unworked, and the reason is stated. Completed items are held at the customer's risk after the collection or despatch period agreed on the quotation.

Where no credit account has been approved in advance, payment in full comes before certificates and items are released. Where credit terms have been approved, invoices are payable net thirty (30) days from the date of invoice.

The quoted price excludes taxes, duties and carriage unless the quotation says otherwise. Overdue balances may carry interest at the lower of one and one-half percent (1.5%) per month or the maximum permitted by law, and work in progress may be suspended while an account is overdue.

The performing laboratory issues the certificate or report, and it remains that laboratory's technical record. Payment in full carries with it an unrestricted right for the customer to keep, copy and use the certificate for its own quality, audit and regulatory purposes.

Certificates are complete documents and may be reproduced only in full; partial reproduction requires written approval. Copies are retained for the period stated in its records policy and can reissue against the original certificate number.

Whatever is obtained or created in the course of a request is held in confidence. That includes drawings, specifications, tolerances, measurement results, and the fact that the engagement exists at all. Personnel and providers who need the information to complete the work receive it; so does a body to which the law requires disclosure, and an accreditation body exercising its rights of access. The customer is notified of a legally required disclosure unless the notification is itself prohibited.

Work is carried out with reasonable skill and care and in accordance with the methods and standards stated on the quotation and on the resulting certificate. Should work be shown to be defective, the remedy is re-performance of the affected work or a refund of the amount paid for it, and the choice between them is the customer's.

To the maximum extent permitted by law, total liability arising out of any engagement is limited to the amount paid for the work giving rise to the claim. Loss of profit, loss of production, loss of contract and any indirect or consequential loss are not recoverable. Liability that cannot be limited by law remains unaffected by these terms.

The laws of Kentucky govern these terms, without regard to conflict-of-law principles. Claims are brought in the courts of that jurisdiction unless a different forum has been agreed in writing.

Revision is possible. Whichever version is published at cmmcalibrationlouisville.com on the date a quotation is issued is the version that applies to that engagement. The privacy and data handling, the legal disclaimer and the complaints policy carry the related terms.
